Article 1 : Area of application
1. The single owner company Andando, slow travel is further referred to as "Andando" in this agreement. Andando is located at the Eliotplaats 197 in Rotterdam and registered in the trade register under file number 24336315.
2. Andando advises, informs and mediates in the conclusion of a contract - in the broadest sense of the word - between you and different accommodators. Andando is not a party in this contract.
3. These general conditions apply to the legal relationship between you and Andando. You herewith declare knowledge and acceptance of the contents of these general conditions.
Article 2: Tenders and offers
1. All tenders and offers on Andando's website are not binding unless explicitly mentioned otherwise.
2. The prices mentioned are in Euro's and always inclusive of VAT, but exclusive of taxes, levies and rights, unless explicitly mentionded otherwise.
3. The prices mentioned in Andando's brochures or on Andando's website are based upon the rates, conditions, levies and taxes, as they are known to Andando upon conclusion of the contract between you and the accommodator. Should these prices change after conclusion of the contract, according to the terms of payment and reservation of the accommodator, under no circumstances will you then be able to claim damages from Andando.
4. If the duration of the rent is mentioned in days, the date of arrival and departure are included and counted as whole days.
5. Andando is not liable for any clerical or general errors or mistakes in tenders and offers.
6. Andando reserves the right to refuse a request for booking without being accountable to anyone.
Article 3 : Website
1. Andando aims to keep the website as up to date as possible. Andando tries to update the website as soon as Andando is informed of changes in services, prices or facilities of the accommodators. Furthermore, Andando aims to keep the website functioning at all times. Andando is not liable for errors and/ or technical malfunctions on the website.
2. Andando's website contains links to other websites. Andando is not responsible nor liable for the content offered on these websites.
3. This website is protected by copyright. The information on this website can only be used for personal and non-commercial purposes.
Article 4 : Coming about of a contract
1. The contract between you and an accommodator is achieved when you submit an application either by phone, fax, e-mail, or by completely filling out the application form on the website in a correct manner, followed by a written confirmation from Andando of the requested booking by letter, fax or e-mail.
2. This booking leads to an independent agreement between you and the accommodator. Andando is not a party in this agreement. This agreement and the applicable law determine your rights and duties toward the accommodator.
3. By submitting a booking request or confirming a reservation, you explicitly confirm knowledge of and consequently acceptance of the conditions of reservation and terms of payment of the accommodator. The conditions of reservation and terms of payment are different for every accommodator. Andando has posted this information on the website.
4. The accommodator will charge you the costs - possibly a cash advance - according to his conditions of reservation and terms of payment. Payment is made to the accommodator directly.
5. You are to pay the costs cash or by credit card to the accommodator, unless the conditions of reservation and terms of payment stipulate otherwise or parties have explicitly agreed to some other arrangement.
Article 5 : Liability intermediary and traveller
1. Andando guarantees that your personal information and/ or credit card information will be treated confidentially. The credit card information is only used for the coming about and execution of the contract with the accommodator. Andando will then destroy this information.
2. It is your responsibility to enquire and meet possible visa requirements, proof of identity, driver's license, green card, automobile stickers and proof of vaccination.
3. Andando advises you to take out cancellation insurance. Should you decide not to do so Andando is not liable for any consequences resulting from the absence of such insurance.
Article 6 : Alterations
In case of circumstances beyond one's control, temporary and/ or permanent, the accommodator has the right to totally or partially cancel the agreement or to temporarily suspend the agreement, without you and/ or third party being able to force the accommodator to observe the agreement nor to claim damages.
Article 7 : Liability
1. Andando is not a party in the agreement between you and the accommodator. Andando is not liable for damages caused to you and/ or a third party by shortcoming of the accommodator when observing the commitments following your agreement, unless the damages are the consequence of deliberate reckless behaviour or neglect by Andando and/ or the people that belong to Andando's management staff.
2. Andando does not accept liability towards you for the amount, nature, content and/ or (in)accuracy of information provided to you by the accommodator through Andando, nor for the consequences of alternations that where communicated or carried out by the accommodator after the coming about of the contract.
3. Nonetheless, Andando will try to act as a mediator in a dispute between you and the accommodator concerning the coming about and/ or execution of the contract.
4. In all cases where Anando is liable, despite of the previously mentioned stipulations, this liablility is limited to a maximum of 25% of the total amount to be paid to the accommodator. Liability for damages covered by usual travelling insurances and the liability for damages caused to you while exercising any or your profession are excluded.
